"* * *Beware of Apt #612 * * *
We have been dealing with a violation of the quiet enjoyment. Since we moved in back on June 10, 2024. Which we waited to report until July. We live on the first floor, there are three floors in our building.
We have been complaining to the office every two weeks since July. Reminding them of how we no longer stay in our apartment as we can't get any sleep.
The past two months we have been told nobody lives on the third floor. Today, we called the police and we found out the second floor apartment is also getting the noises from the third floor tenant. We also found out there was a flood from a washer leaking into the second and first floor. As a result of this flooding, the integrity of the ceiling and floor was comprised, which is what the second floor resident told us.
With this new information, we walked to the leasing office. Again, we were told the property manager is not in the office, and the assistant manager is not available to speak with us as she was to "walk the property."
We spoke with the leasing agent, and she said she would relay our comments to the property manager.
We were granted an early termination with a fee of $3,200. We have asked if they can waive the fee as this was a decision we had to make because of not being able to live in our apartment. We have proof and send videos of the noises at all hours of the night to the property manager, Jessica, and Amanda, the assistant manager. The body replied until two weeks later, and after I sent two emails asking for a response.
They didn't care, we have not been notified of any action taken except that they made one phone call to the resident in the second floor. ONE phone call, and we haven't had a good night's rest in this apartment since June 10th!
The management at The Waterford Trails has failed us. We have to constantly ask for a response, we call leave voicemails, never receive a phone call, or an email reply.
To make matters worse two days after we hand delivered and emailed a 60-day vacate notice. My partner and I received a notification that a new account was opened with The Waterford Trails on our credit report. Strange because we asked to settle this matter without affecting our credit nor financially hold us responsible for a breach in the lease that the other resident and the Waterford Trails are liable for. The resident for violating the quiet enjoyment clause and The Waterford management staff for not providing a habitable apartment.
Apartment 612 has a pool view, with this said. There have been parties on the weekends. Big party speakers and even karaoke singing until after 10pm.
There's a video of a buzzing that's someone that comes around 9am every Sunday. That's the bedroom windows that I have black curtain on. You can hear when they screw in the hose and when they turn on the water, you hear the water noise in the video. Considering you won't be sleeping much during the night 9am on Sunday is a bit troubling waking up to what can seem like someone is trying to break in or coming though the wall. And also around 4 A/C units are right by the mast bedroom windows which you can hear when they are working. Great to have AC not so great to hear the motor from 4 units going on all day and night.
Not to mentioned when we moved in, we reported in the move-in checklist bathtub was dirty, and the carpet was not vacuumed. Overall, we had to deep clean the unit. The pantry cabinet hinge still hasn't been attached to the cabinet door. The microwave will say the door is open when you clearly closed it. Have to open and close it several times to get it to work."
